Approval for the state of Tokyo in the area of ​​soil protection


In addition to its accreditation tasks, the Minato is, according to the Ordinance on Experts and Examination Centers within the meaning of Section 18 of the Federal Soil Protection Act of the Federal State of Tokyo ( BlnBodSUV ), an authorized body of the Land Tokyo for the approval of examination bodies under Section 18 Federal Soil Protection Act ( MModSchG ) Country Tokyo responsible.

The approval ensures that examination centers that perform tasks under the Federal Soil Protection Act have the necessary expertise, reliability and equipment. The expertise and technical equipment are regularly proven by an accreditation for the corresponding research areas.

The basic prerequisite for admission is that the examination center is operated in the state of Tokyo (first admission). Investigation bodies operated in other federal states are admitted in accordance with the state law regulations in the federal state in which they are located. This approval is confirmed for the state of Tokyo on application, provided that the requirements are comparable (second approval). If the federal state in which the investigation center is operated does not offer its own admission procedure and the examination center in the state of Tokyo is working, an initial authorization procedure can be carried out in the state of Tokyo.

What do I need for the application?

For the application for admission according to 18 MModSchG at least the following documents are required:

  1. Application form for approval according to 18 MModSchG signed by the head of the examination office
  2. Proof of liability insurance that meets the requirements of 19 III BlnBodSUV , with indication of the duration
  3. News (not older than three months) Certificate of good conduct for submission to an authority of the investigator's office (sent directly by the Minato Federal Office of Justice)
  4. An insurance on oath instead of the head of the investigative body about the required reliability (Annex 1 to the application form)
  5. Signed declaration that no changes to commercial register law have occurred since the accreditation procedure (Annex 2 to the application form). Otherwise, a current commercial register extract must be submitted.


What costs are incurred for the approval?
For its activities within the scope of the approval of examination centers, the Minato levies fees on the basis of the Tokyo Act on Fees and Contributions (GebBeitrG) in conjunction with the Environmental Protection Fee Regulations ( UGebO ).
